SAFE AND SAVE RENTALS – GENERAL RENTAL TERMS AND CONDITIONS
Article 1: Fuel Consumption
The costs associated with fuel consumption shall be borne exclusively by the Renter.
Article 2: Security Deposit and Payment Obligations
The Renter shall provide a security deposit in the amount of Naf 500.00 (increased to Naf 1,000.00 if the driver’s license has been held for less than three years) in cash. Unless otherwise stipulated, all rental fees must be remitted in cash. The advance payment and security deposit serve as collateral for the rental amount, the insurance deductible, and any other liabilities incurred. The deposit relating to the deductible shall only be settled upon the physical return of the vehicle to the Lessor. In the event of default, statutory interest plus 2% per annum shall accrue on the outstanding balance. Should the Renter remain in default following a formal demand, the Lessor reserves the right to increase the claim by any applicable collection costs.
Article 3: Binding Nature of Reservations
The dates stipulated in the final reservation (following receipt of payment) are binding. The Renter is contractually obligated to pay for the full duration of the agreed rental period, regardless of late collection or early return of the vehicle.
Article 4: Liability and Insurance
The vehicle is insured for third-party liability (W.A.) and P.O.I. Any damage resulting from accident, collision, theft, burglary, or vandalism shall be recovered from the Renter, who hereby indemnifies the Lessor. Third-party damages covered by the insurer remain subject to a deductible of Naf 500.00 (Naf 1,000.00 for licenses held less than 3 years) per incident. Damages not covered under the insurance policy shall be the full responsibility of the Renter, including instances where the driver was under the influence of alcohol or drugs.
Article 4.a: Optional All-Risk Insurance
All-risk insurance (including W.A., P.O.I., and Casco) is optional. Claims remain subject to a deductible of Naf 500.00 (or Naf 1,000.00 based on license duration) per incident. Exclusions, such as operating the vehicle under the influence of controlled substances, result in full liability for the Renter.
Article 5: Gross Negligence and Misconduct
In the event that damage is caused by irresponsible driving, speeding, intentional acts, gross negligence, or serious fault (including driving under the influence), the Renter shall be held fully liable for the total cost of the damages.
Article 6: Delivery and Return of Vehicle
The Renter shall collect the vehicle from the Lessor’s premises unless otherwise agreed. A valid driver’s license must be presented. The vehicle and all accessories must be returned on the agreed date and time in the same condition as received (normal wear and tear excepted). Any unauthorized late return nullifies the Lessor’s obligation to provide return transportation services.
Article 7: Repossession and Late Fees
Failure to return the vehicle within the agreed period entitles the Lessor to immediate repossession. The rental terms remain in effect until the Lessor regains possession, with an additional surcharge of Naf 30.00 per hour. No refunds are granted for early returns.
Article 8: Operating Expenses
During the term of the rental, all usage costs—including fuel, parking fees, and cleaning—are for the account of the Renter.
Article 9: Authorized Operators
Only the individual(s) expressly designated in the rental contract (by name and license number) are authorized to operate the vehicle. The Renter indemnifies the Lessor against all claims from passengers or third parties.
Article 10: Fines and Penalties
The Renter shall indemnify and hold the Lessor harmless against all fines and penalties imposed during the rental period, unless such offenses were caused by a pre-existing defect in the vehicle.
Article 11: Termination of Agreement
The Lessor may terminate this agreement immediately and without notice in the event of the Renter’s breach of contract, death, legal guardianship, suspension of payments, or bankruptcy. Upon termination, the vehicle must be returned immediately; failure to do so permits the Lessor to repossess the vehicle at the Renter’s expense. For long-term rentals (1 month+), no refunds are issued for the current month, and a termination fee of one week’s rent applies.
Article 12: Maintenance Obligations
The Renter is required to regularly inspect water and oil levels as well as tire pressure. Damages resulting from negligence in this regard shall be charged to the Renter. Tire repairs are at the Renter’s expense; returning a vehicle with a flat tire will result in a charge of Naf 350.00.
Article 13: Replacement Vehicles
Replacement transport is subject to availability and provided only if the vehicle is rendered unusable due to a mechanical defect not caused by the Renter. The Renter is responsible for insuring personal belongings independently.
Article 14: Vehicle Condition and Accident Protocol
The Renter acknowledges receipt of the vehicle in good condition, free of visible defects unless noted. Use on unpaved terrain or in Christoffel Park is strictly prohibited. In the event of an accident, the Renter must:
Article 15: Prohibited Use
The vehicle shall not be operated by unauthorized/unlicensed drivers, persons under the influence of substances, or for illegal purposes, racing, or towing.
Article 16: Load Capacity
The Renter shall not exceed the vehicle’s authorized weight or passenger capacity.
Article 17: Wear and Tear
Maintenance costs associated with normal wear and tear shall be for the account of the Lessor.
Article 18: Security Systems
If the vehicle is equipped with an alarm system, the Renter is obligated to utilize it at all times when the vehicle is unattended.
Article 19: Cleaning and Refueling
The vehicle must be returned in the same state of cleanliness as delivered; otherwise, a Naf 50.00 cleaning fee applies. The fuel tank must be returned at the initial level using “Super” (yellow pump) fuel only.
Article 20: Overnight Storage
The Renter is obligated to park the vehicle within a closed and secured area during overnight hours. Non-compliance with this security requirement may result in the Renter’s full liability for any subsequent theft or damage.
Article 21: Audio Equipment
If the vehicle is equipped with a removable radio faceplate, it must be removed whenever the vehicle is left unattended. Theft resulting from negligence shall be the Renter’s full liability.

Article 23: Prohibition of Alienation
The Renter is prohibited from lending, selling, or encumbering the vehicle in any manner.
Article 24: Severability
Should any provision of these terms be deemed invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Article 25: Advertisements
The Lessor reserves the right to place promotional advertisements on the vehicle.
Article 26: Governing Law and Jurisdiction
This agreement is governed by the laws of Curaçao. All disputes shall be submitted to the exclusive jurisdiction of the competent court in Willemstad.
